[irrelig]The long-requested, long-withheld episode on Proposition 8 has finally arrived. We talk briefly about the history of California marriage law, and the seesawing legislation, voter initiatives, and court judgments revolving around gay marriage dating back to the 1970s. We discuss the (LDS-funded) campaign materials and commercials in favor of Proposition 8, which represent arguments made to the voters, and the complete rejection of those arguments in favor of totally different post-hoc arguments made by (LDS-funded) attorneys to the judge. Finally, we talk about the judge’s rejection of all of those arguments, pre- and post-hoc, to strike down Prop 8.

Also, zookeepers put the gay penguins’ gayness to the test.

  2. Well, thank you! I still have to listen to the podcast, but I’m sure it will give me some insight why so many Americans are against same sex marriage. I’m from the Netherlands, where gay marriage and adoption are legal, like euthanasia and abortion, and where smoking pot is totally allowed. Most of that happened in a timespan of twenty years or so. Whole clusters of Christian taboos collapsed. This podcast should prove really interesting! The upheaval over prop 8 must be a sign of better times to coming to the USA.

    Just a thought, I think I finally figured out what Mormonism is. Joseph Smith invented a religion to make money and fuck as many women as possible.

This should make it a whole lot easier for marriage equality to conquer the US. It’s a grand victory of reason over religion!

  18. The judge’s ruling is genius – ruling on the facts, yeah! I can’t see how the supremes could possibly overrule it. The prop 8 people didn’t have shit. it was ludicrous. But you never know, don’t forget Dred Scott.

  21. I’m about to listen to this podcast, as soon as my iPod battery is charged! Prop 8 is what pushed me to get around to actually formally leaving the Mormon church, after not going for 25 years.

    Seriously guys, I could talk to you about “Drawing on the Powers of Heaven” and other missionary horrors. I’ve been there!

But, I am hopping for a Prop 8 Part 2 where you go through all the underhanded ways the Mormon church went about secretly promoting Prop 8 as described in the film “8: The Mormon Proposition.” For example, I heard a first hand account of how a bishop in Arizona dismissed sacrament meeting to send members out to collect money for Prop 8.

  31. This was a fucking great episode. I wish we Californians could have known more of this at the time of the Prop 8 vote. I had many arguments with coworkers and relatives that this stuff would have helped… but now I have it for when the Supreme Court finally settles it and the whining seriously settles in. I wonder what my very Christian aunt will think when she finds out 90% of the Prop 8 funding came from the Mormon church. Hahahahaha!

  36. I quite enjoyed the two hours of non-stop content. Before listening to this I didn’t quite know how to wrap my head around the whole gay marriage issue. I felt like it was vaguely similar to the civil right stuff in the 60’s.

    But man this podcast was super educational. I loved the findings of fact and the utter incompetance and bigotry of the defendant interveners. It somed my just how motivated the opposition is by bigotry. Definitly gonna share this!

  40. Been meaning to comment on this for ages but I keep forgetting:
    1. Religion is a suspect class in the US it just wasn’t mentioned in the list in the court case. Interestingly it isn’t in Australia, you can only claim remedy for racial discrimination; so you could sue as an Irish Catholic but not if you converted to Catholicism.
    2. I strongly suspect any supreme court case on gay marriage will start with 6 of the justices already decided 4-2 against the gays (maybe 4-3 Kagan has been pretty vocal against don’t ask don’t tell). At the very least I believe Thomas and Scalia will never vote to allow gay marriage no matter how persuasive the reasoning. Don’t be surprised if the ruling is 5-4 against gay marriage straight along party lines.
